Dhanush sues Nayanthara over using 'Naanum Rowdy Dhaan' footage for Netflix documentary

Actor Dhanush has filed a civil suit against Nayanthara for using visuals from his production Naanum Rowdy Dhaan without obtaining permission for her Netflix documentary Nayanthara: Beyond the Fairy Tale.

Dhanush's Wunderbar Films Private Limited — which had produced the 2015 movie — filed the case in the Madras High Court against the Jawan star, her director-husband Vignesh Sivan, and their production house Rowdy Pictures Private Limited.

Dhanush's company also filed an application urging the High Court to permit them to sue Los Gatos Production Services India LLP — a Mumbai-based entity through which Netflix reports its content investments in India — for having used certain visuals of the Tamil movie. Wunderbar Films wants to sue the company, along with the others, within the territorial jurisdiction of the Madras High Court.

The court heard preliminary arguments of both parties and the judge has allowed the application to grant leave (permission), noting that a major part of the cause of action had arisen within the jurisdiction of the Madras High Court.

The Hollywood Reporter India has learnt that Dhanush's company has only demanded that the BTS (behind-the-scenes) footage from the sets of Naanum Rowdy Dhaan be removed from the footage of the documentary on Netflix, since it showcases art, decor, set pieces and other actors and crew members who were part of the 2015 Tamil film; the rest of the documentary can be screened. A tentative amount of 1 crore has also been sought in damages to resolve the issue, which will see further developments over the coming months.

This comes days after Nayanthara had penned an open letter against Dhanush, calling the actor "vengeful and vile" for refusing a No Objection Certificate (NOC) to use audio and video from Naanum Rowdy Dhaan. Nayanthara had claimed that Dhanush sent her a legal notice after the release of the trailer of the Netflix doc, questioning the usage of a three-second clip.

"We were startled to read those lines wherein you questioned the usage of some videos (just three seconds) which were shot in our personal devices and that too BTS visuals that are already very much publically present on social media and claimed a sum of Rs 10 cr as damages for mere three seconds," a part of her statement read.

Nayanthara: Beyond the Fairy Tale has topped the charts on Netflix India since it was released on November 18, coinciding with Nayanthara's 40th birthday.
